3) What is the legal impact of the Letter of Direction to Trustees?

The Letter of Direction to Trustees (LODT) is NOT generally a legal document. We do NOT believe it is prudent to try and “rule from the grave” for many reasons, including the inability of any of us to accurately predict what the world will look like far into the future. Consequently, the LODT is generally a non-binding guideline to your trustee. However, in the event you wish to evaluate making consideration of the LODT, or certain aspects thereof, by your trustee something other than purely voluntary, you will need to work with your law firm, and we will be happy to assist in any way possible.
